P.O. Box 113, Troy, MI 48099
Policy Letter regarding: OUTSIDE ANTENNA AND/OR SATELLITE DISH
ELV Policy #009 updated and approved February 3, 2009
Primary location shall be the rear wall or roof of the residence.
Secondary location shall be the side wall or roof of the residence.
If either of the foregoing locations (#1 or #2) are utilized, no notification to or authorization from the Emerald Lakes Village Homeowners Association is required for the resident homeowner to proceed with installation.
If the installing contractor determines the locations in #1 or #2 are not satisfactory to acquire an acceptable signal, the next suitable location will be the front wall or roof of the residence.
The final and least desirable location is a ground-mounted antenna on the property that is set apart from the residence. This location shall be a last resort and used ONLY if acceptable reception cannot be achieved using a building mount as noted above. Care must be taken in utilizing a ground-mounted antenna so as not to obscure the view of the lake from any adjacent property.
Locations noted in #4 and #5 above REQUIRE the resident homeowner’s antenna installation vendor to certify in writing; to the ELV President or Restrictions Chairperson, PRIOR TO INSTALLATION, that locations noted in items #1 and #2 above cannot be utilized due to receiving an unsatisfactory signal and also note the cause of the inadequate reception. The placement of the antenna in locations other than those specified in #1 or #2 must be mutually agreed upon by the homeowner and the Emerald Lakes Village Homeowners Association.
If a location noted in item #5 above is used, the antenna shall be painted, or otherwise camouflaged, in a manner so as to blend into its surroundings; and care must be taken to not obscure the view of the lake from any adjacent property.
See the City of Troy Zoning Ordinance TITLE V - ZONING AND PLANNING 40.58.00 ACCESSORY STRUCTURES and also see http://www.fcc.gov/mb/facts/otard.html, Federal Communications Commission Information sheet dated December 2007. The antenna and the installation must conform to all local, state and federal regulations and restrictions.
Antennas used for AM/FM radio, amateur ("ham") radio (see 47 C.F.R. §97.15), Citizen's Band ("CB") radio or Digital Audio Radio Services ("DARS") must be attached to the dwelling and the antenna and installation must conform to all local, state and federal regulations and restrictions.
